DURANT, OK - Commissioners in Bryan County are preparing to file a lawsuit against the Oklahoma Department of Corrections.

Commissioner Monty Montgomery tells us the lawsuit will address the state housing too many inmates in the Bryan County Jail, which is preventing the county from using the jail for its own needs.

Commissioners say the state is only paying the county $27 a day for each inmate, but it costs the county $43.58, and that extra amount that's not covered is becoming a financial burden for the county.

Next Monday officials will meet in an executive session about the next step in taking the Department of Corrections to court.
