LONE GROVE, OK - The Oklahoma Court of Appeals has sided with the City of Lone Grove after a former city manager filed a lawsuit against the city for "wrongful termination".

City attorney David Pyle said Marianne Elfert's appeal was denied by the court on Sept. 6.

Elfert then was granted twenty days to ask for a re-hearing in her civil case against Lone Grove.

Pyle said Elfert was fired from her position as city manager in June 2010.

Elfert claims her termination was not legal, however Pyle said the court of appeals found no violations in her firing.

"They agreed with the trial court that there was no facts in dispute and that the facts were relied on that the city did not violate the Open Meeting Act," Pyle said.

Pyle said Elfert has until Sept. 26 to appeal their findings.
