DENISON, TX -- The case against a man accused of driving into a Denison home killing Jennifer Comstock and her unborn child is moving forward as scheduled.
In court Thursday morning, Richard Allen Taylor's defense attorney made a motion to continue the trial.
Saying Taylor's toxicology report from the January night in question is "erroneous" and he'll need more time to have it evaluated by a third party.
Prosecutors say they'll be ready for the jury trial on December 9th.
Judge Brian Gary will decide if a change of venue will be granted at a motion hearing Nov. 18.
