GRAYSON COUNTY, TEXAS -- The Grayson County Sheriff's Office confirms that Ricky Trent Stanley, the suspected drunk driver accused of hitting and killing Deputy Chad Key, was not driving his own truck at the time of the accident.

Lt. Rickey Wheeler says Stanley was convicted of DWI in 2002 and 2004, and was out on bond for a third DWI arrest from August, when the truck he was driving struck Key.

Sheriff Gary says Stanley was one court date away from possibly going to prison for his three DWI arrests at the time of the accident.

Wheeler says a condition of Stanley's bond was to have a "deep lung device" on his truck, so driving someone else's truck was unlawful.

It is a felony to tamper with devices like the deep lung device.

DPS Trooper Mark Tackett says the vehicle Stanley was driving at the time of the accident is a 2004 F-350 pick-up truck.

Key's funeral is set for Thursday morning at First Baptist Church in Sherman.
