9-9-04 - OKLAHOMA CITY (AP) State Insurance Commissioner Carroll Fisher repeated his vow not to resign after he watched the state House of Representatives impeach him today.

The House impeached Fisher for corruption, neglect of duty and incompetence.

Fisher says he will not surrender and by resigning he would give up his right to defend himself. He also says he's not surprised by the vote to impeach him.

The case now goes to the Senate for trial where Fisher would be removed from office if convicted. A spokesman says the Senate will meet Tuesday to set a trial date.

Fisher's attorney has said he'll ask the Senate to delay the trial until after criminal charges against Fisher are resolved.

Fisher faces felony charges including embezzlement as the result of a multicounty grand jury investigation.
