The suit blames Monday's wreck on negligence by truck driver
Miroslaw Joswiak of Daytona Beach, Florida. The driver of the 18-wheeler has been charge with ten counts of criminally negligent homicide.
The suit also names KV Trucking and KV Express, and the trailer's owner, Eagle Express Lines.
The rig collided with an SUV and a pickup -- killing five
people in each of those two vehicles.
The lawsuit also alleges Esparza's employer, the Sta-Dri Company, of making seven employees travel in a truck that couldn't accommodate that many safely.
An attorney for the trucker didn't immediately return a call today for comment.
