Second Suit Filed in Deadly Accident

10-01-04 – A second lawsuit has been filed as a result of an accident in Sherman that killed ten people.

Mike Martin and the parents of his wife, Lisa Martin, filed a lawsuit in Grayson County this week. Lisa, her three young sons, and her mother died in the September 20th crash on Highway 75.

Their family is suing the driver of the semi that hit the Martin’s SUV, Miroslaw Jozwiak. He is still in the Grayson County Jail facing 10 counts of criminally negligent homicide.

The lawsuit also names the trucking company, KV Express Inc. and the owner of the trailer, Eagle Express Lines Inc.

The suit does not demand a dollar amount. The attorney for the family, Travis Clardy, says the Martins want a jury to set the amount.

This is the second lawsuit stemming from the deadly crash. Last week, the family of one of the men riding in the other pick-up truck involved in the accident filed a 75 million dollar wrongful death suit.
