10-26-04 - AUSTIN (AP) Some teachers groups have brought a lawsuit to prevent bigger class sizes in Texas.
The dispute involves whether schools should be able to ignore the 22-student class size limit for kindergarten through fourth grade.
The groups, including the Texas Federation of Teachers, are concerned about a recent letter from Education Commissioner Shirley Neeley to superintendents.
The law allows school boards to seek waivers to the 20-year-old law.
The decision to seek a waiver generally must be n a school board agenda; so the public has input.
Neeley's letter outlined options that would give superintendents the authority to seek waivers directly from the Texas Education Agency, bypassing public input.
TEA spokeswoman Debbie Graves Ratcliffe says Neeley supports the class size rule; but was trying to provide boards with another option to streamline the process.
