Former Officer To Plead Guilty To Child Porn Charge

3-28-05 – A former lieutenant with the Sherman Police Department will plead guilty to one count of possession of child pornography in federal court this week.

Todd Smithers resigned from the department March 3rd as the FBI investigated the allegations.

The criminal and federal investigation began on February 10th; the officer was put on paid leave.

A plea of guilty was filed Monday morning. The court will later designate a date for the sentencing hearing.

A statement issued by Smithers’ attorney, Bob Jarvis, states, “Todd has been ill for a long time now. I am amazed he was able to perform his job for as long as he did. Todd has an addiction and is currently undergoing long-term, in-patient treatment. This has been a very difficult time for him and he is struggling to cope with the situation.”

The statement also says, “Todd has asked me to convey to his family, friends and fellow police officers his sincere apologies for the pain and embarrassment his actions have caused.”

Smithers has served as the public information liaison for the Sherman Police Department. Before his resignation, he was the officer in charge of department standards.
