Murder Charge Sticks in ECU Student Death

4-13-05 - ADA, Okla. (AP) A judge in Ada is rejecting a request to reduce the first-degree murder charge against a man accused of killing an East Central University student last September.

Ammon Dean Reich is accused of using his pickup truck to ram into a pickup carrying Joseph Tusan and ten other students. Tusan was killed and seven students injured, one is paralyzed.

Reich's attorney says the first-degree murder charge should be reduced because Reich did not intend to kill anyone.

Prosecutors say Reich intentionally bumped the other pickup three times before it crashed and the judge agreed that the question of intent to kill should be decided by a jury.

Reich remains free on 125-thousand dollars bail and is to stand trial beginning June 14th.
