Punishing Mentally Retarded Offenders

5-4-05 - A Bryan County mother is upset with the Oklahoma legal system because the man accused of raping her young daughter will likely never serve prison time. Paul Edward Watts was a family friend until her molested the girl while he was babysitting. But the court has ruled Watts incompetent to stand trial because he is mentally retarded.

Despite her anger, prosecutors say a change in state funding will mean that they control Watts incarceration in a mental facility.

They’ve delayed his hearing until next month – waiting for the change to take effect. It gives the courts more authority over the facilities people like Watts are placed in. And now those facilities must be secure and supervised.
