DURANT, Okla. -- A Durant police officer is on the other side of the law. Lt. Johnny Rutherford was charged Tuesday with felony second degree burglary after months of an internal investigation.

Rutherford is accused of breaking into the Morrison Drug Store in Durant on November 27, 2007, to steal prescription pills. The crime was even caught on tape. According to OSBI investigators, Rutherford admitted it was him captured on surveillance video inside that pharmacy to OSBI investigators in February.

After admitting to braking into the pharmacy, Rutherford confessed to burglarizing attempting to burglarize the home of his brother-in-law on two separate occasions. Rutherford stated he did steal anything the time he was able to enter the house, because the drugs he sought were inside a locked box.

The Durant police officer is also charged with misdemeanor crimes of malicious injury for breaking into the pharmacy and damaging a restroom wall.

Soon after the investigation started, Rutherford took personal leave but now is on administrative leave.

Rutherford posted bond shortly after turning himself in to Chief Durward Cook at the Durant Police Department on Tuesday.

What Johnny did cannot and will not be condoned. He wil pay the same price as any person in his situation.I dont remember any mass postings when Johnny saved a life or stopped the rape and bone breaking of children or adults. Oh but that was his job. Johnny was man enough to do for 20 yrs. No one realizes or cares how your life is altered forever in some good ways but mostly bad ways. But no one care. Do they. I was in the trenches with him. I know without doubt, until the end he was 100% good cop. He had the courage, dont forget it.

I hope that none of you haters have to go through an addition or a friend with an addition. For sure if you did you wouldn't be so quick to judge. It's not like he just all of a sudden one day decided to start abusing drugs. We are talking about perscribed medication that he was unfortunate to become addicted to. You know medications do have those side effects. But I guess all of you are better than your bodies and could of stopped it. Sure he should of gotten help as soon as he realized but do we know when that was? I bet the day he made a big mistake and tried to break in. You haters make me sick, really sick. Dookey, I have been a friend of Johnny for a long time. He lost all three of his family members suddenly one being his almost twin sister in a car accident. He placed his losses away to continue his job which was investigating child sexual abuse and protecting women from domestic abuse. If you had a child that has been abused He would not rest until the bad guy was in jail. He has served Durant for 20 years without a blimish on his record and treated people with respect. He is a good man!! and for your comment about speeding down the highway taking drugs? WOW look out people a 4000 lbs deadly weapon coming right at you. But wait, your a good person, right?

Taxpayer. You make a pretty good point. Looks like the “one bad cop” is not the only law enforcement problem in Durant. The so called officers of the law that have posted here have exhibited very childish, arrogant, and disrespectful remarks about people that are only expressing their opinion on a forum that is here for that purpose. Is this the attitude they bring with them to their jobs? Calling people morons, idiots, and wanting to slap people for making comments, and making other personal insults. Most people addicted to pain killers or Xanax go to multiple doctors and pharmacies. It's not necessarily the physician's fault. Too bad there is not a nation-wide data base to keep track of everyone's medication. SS# with NDC # of drugs.

I don't a lot, but I'm going to tell you what I do know: I was going thru a divorce and had three small children. I was living with my Dad. I came home one day and found him dead. Shortly thereafter, a good friend of mine died. All this time, I was abusing pain medication because I had been hurt and became addicted. Sure, it was a rough stretch of time in my life, but I NEVER broke into a pharmacy. In fact, I never did anything illegal except speeding on the highway and taking drugs. I know that is bad enough, but you get my drift. I sought the help I needed, and did a little stretch in Green Oaks hospital in Dallas, which is a rehab facility. What I'm saying here,is, to all the "have you not known anyone on drugs?" people, is YES I DO, have and was! You can't say he is a good guy, you just CAN"T! He did a terrible thing in my mind, and apparently a lot of others too. He could have gotten help. He just chose to feed his addiction!

THere is no doubt that Johnny made a mistake. It is a sad day in law enforcement. However, in reading posts on this blog, one apparent theme is that Johnny should be treated the same as similar defendants charged with similar crimes. I agree 100%. What most of you idiots dont realize is that all defendants in his shoes get PR bonds and probation sentences. Doesnt matter what color you are, how much money you have, or what you do for a living. The only people that go to prison are those with lengthy criminal histories, who fail on probation, and who are just plain good for nothing. SO when Johnny does get his probation, and you idiots start making your uneducated slanderous comments, just know that he is not being treated different. In fact, just read the Durant newspaper every Friday and you will see that virtually no one goes to prison in Durant. Well, I've got to go now, get my coffee and donuts, and wait for some of you morons to drive through my town.

How terribly sad that so many seem so quick to judge. When I read the nastier comments from those who choose to be judge, jury and hell-bent executioners, I am sadly NOT shocked. Small town, smaller minds. Some folks in that sleepy little community have little to do than gossip. Heck, it's a downright art form in Durant! Hey, if it makes you feel good to see a decent man stumble and fall, then by all means, jump in the middle of him and his entire family and beat them while they are down. BUT, remember that the good ole Bible says..."What you sow you will reap." God forbid you should stumble and fall someday. If you do, you who have been hateful and so terribly NASTY will get the same treatment you are giving Mr. Rutherford. Yes, he needs help in the worst way and I truly pray he gets that help...But those who choose to condemn need more help than that man ever will. A SAD commentary on my former home. Is Johnny 1 of the 6 they are still looking for in the Fannin Co. Drug Bust.No he can't be because he was stealing from friends and family to support his habbit and it didn't say those in Fannin Co. were doing crimes to others, just addicts. I hope the Pharmacy don't raise their (OUR) prices so they can cover their Insurance premium that will be going up because of poor ole Johnny. I am glad my daughter is leaving Durant (SOSU)as I am not so sure of the protection and perception our young kids are being being provided in Durant OK.

This cop gone bad had no business being a law enforcement office if he was taking these types of medication for either the mental and/or physical condition he was in. There is no excuse for this person that is trusted to do the right thing. He knew what was wrong with him and what he was taking, unless he really is mentally unstable.

well i have something to say about all of this, first of all a officer should know better and yes he should have to be treated like everyone else and get the same treatment, but not every officer is bad. and saying that all the blogs are mean and he and his family is being mistreated well he didn't mind putting other people who might have been down on luck in jail and they might have just had bad luck to. if everyone would think about it not everyone who is in jail has past records so if were suppose to let him off what about the other people. i feel as a tax payor he shouldn't be on any kind of leave with pay if he gets paid for what he does why not pay all the others. our children are suppose to look up to these officers and most of the they can we have great dpd,county and ohp officer and as for as mr.dungan what does he have to do with all of this. he's a fine man. i support all of our good officers and stand behind them.

I want to first start by saying that my heart goes out to Johnny and his family. My husband used to be in law enforcement and I was lucky enough to have met Johnny. He is a good man who had a lapse in judgment. Just because he had a problem with the medication doesn't make him a bad person. I hope that people will stop talking about this and let Johnny and his family start piecing their lives back together. Johnny is a good man and I would still think and speak highly of him! For Johnny and his family...there are always going to be the idiots that talk about something they know nothing about, so let them, they aren't worth your time or energy thinking about them. You will see who your true friends and supporters are and you will see that one day this will have been just another story in the past. God bless all of you! And just remember, you are not alone!

To all of those who have never been perscribed anything for anxiety, depression or pain or to those who have never had someone in there family perscribed these you need to get some evidence. What you don't understand is that with these medications they can alter your mind to a point that you really don't know what your doing. There are people that go off and do I mean just astronomical things that they would never do and don't even realize there doing it. Then when you realize there is a problem and try to stop the medication you can't. Please people stop judging someone for one mistake that was not due to being a bad person but from being perscribed a bad medication.

Take some anti anxiety or depression medicine and see how it affects you. The problem with these medications, and I know because I have been perscribed several different kinds,is that you don't necessarily know what is going on with you. The medication alters your mind so much you don't know what your doing. Have you people not heard about people on that anxiety sleeping bill that leave there house in the middle of the night, in a walking sleep state and get in there cards and drive off and get into a car wreck. Ask Jack Nicholson, when he was on it he got in his car in the middle of the night and almost drove off a cliff not a few blocks from his house. These medications alter your perception to where you don't know it is altered and then it's to late your addicted.

Mr Rutherford's actions are shocking and should not be ignored. He deserves punishment and a serious case of drug rehab. I just hope that neighboring police forces keep their eyes open for suspious activity like this so this doesnt happen again. I mean seriously. He was under the influence when he was "serving and protecting" us.

After I read the post by Someone with Common Sense, it reminded me of a situation that happened a few years ago. A friend of mine was prescribed medicine for depression. For awhile it worked well. Then his behavior changed. He lost a lot of weight, couldn't sleep, his mind was racing and he was just not the same person. Before it was over with, he did some pretty irrational things. Later on, I read where this drug had caused the same reaction in other people. After his medication was changed he became very stable. So it would be pretty easy for me to believe that this occurred to this officer, because I have seen it firsthand. I also have to agree that a first time offender for burglary is likely to get probation or a deferred sentence. I wish the best for him and his family. This too shall pass.

We put these people, (cops, clergy, teachers ) on pedastels, and then when they fall, we act all surprised. The truth is they are human with flaws like the rest of us. The sad reality, is this goes on in law enforcement all the time, those belts are murder on the back and hips and you would be surprised how many take pain killers on a reg. basis. they are like our athletes, we know it goes, on we don't want to KNOW it, we just want results. Then there is the blame it on the doctor when it's not an average person. If that had been a junkie on the video, we would have read and entirely different story.....

Hey people no one is saying he should go unpunished. He should serve the same as someone in the same similar situation. I can definitley say he is a first time offencer. What do you think the offense is for a first time offender for burglary?? He didn't even steal anything. The punishment would more than likley be paying for the damages, community service, fines, probation, and they would probably do rehab as well in this case to help him out. No one is saying he shouldn't be treated the same. Why do you think that the local DA stepped down on the case and it was handed over to the OSBI? Because our town wanted to make sure there were no impartialitites and that he would be treated the same as any first time offender of that crime. You people make me sick! Worry about your own community and leave ours alone!! And to you local cop haters move!!! He was prescribed a medication to deal with some serious issues and it altered his mind not like he knew what was happening!!

This officer did not use his job in any way to committ a crime. He has not done anything whatsoever wrong in his job. Why do you think he took personal leave!!! You need to print this thread out so you can sit down, read it, study it, and then have someone with intelligence explain it to you so that you can understand what I have actually said. Common sense, anonymous, Summer: Yes, the average joe with no priors and roots in the community would not only be on the streets on bail, they would likely be out on their own recognizance. If he has a job of responsibility, his career is likely over and he'll be ordered to undergo treatment as a condition of his release or probation. All of which are likely to happen to this officer. Just hearing the stories secondhand on the cases Lt. Rutherford has worked on over the years is enough to make me depressed. Throw in a couple of family tragedies, a doctor that apparently was all to willing to dispense without follow-up care, and it's "there but for the Grace of God go I." I might also mention the lousy way that the City of Durant handles such things, hiding in their little Ivory towers instead of supporting their officers. Hiding the story for 3 months didn't help anyone. In fact, it reeks of an attempted cover-up.

Of coarse that didnt make the headlines. I do feel some sympathy for this man, however he should be put through the same ringer that everyone else must go through. If anyone who should have known the consiquinces of commiting a crime it is a police officer.

Attn Police...I have several family members that are in law enforcement & I know what they go through on a daily basis, Johnny still makes me sick, he did the crime & he needs to pay. There are good cops & bad cops, more good than bad, the bad cops will get caught. Why did he do it? You can't blame the doctors for writing the RX.

Republican, I agree with you 100%. You know if it was your average Joe that did the crime they would probably still be in jail. Can't say I feel sorry for him or his family. I too am shocked by all of this. I have know Johnny for serveral years and don't think you could find a better person. I know the past couple of years have been very hard for him, and prescription meds were prescribed to him. It is a shame that drugs that are supposed to help you turn you into something/someone you are not. Johnny you and your family are in my thoughts and prayers and I know you will get thru this. You have done many good things and one slip up doesn't make you a bad person in my book. Hang in there!!!

Him being a police officer has nothing to do with the crime, he isn't charged with being a police officer while committing a burglary, he's just a human who did something wrong. Just like any other profession can do wrong and commit a crime, so can a police officer. They are human to. Let the justice system do it's job and let the man get some help with his problem. I'm sure there is so much more to the story than any of us will ever know.

If you don't like what people are saying it's simple "avoid the comments".. Let's not forget why he is in the new's and in the local paper... For one how long would he have kept this a secret? Obviously the only reason he turned his self in was because OSBI Agent Reanae Childers knew it was him on the video. How much money did this cost the state to do an investigation? If he was a "good guy" he would have turned his self in after the incident right? I guess the reason he never "stole" anything was because when the alarm went off he knew the police would be on their way. And did it say he broke in to his own brother in law's house not once but two times? Hmm.

I have had the pleasure of meeting Johnny Rutherford twice.I have the highest regard and utmost respect for him as a police officer and as a man!! I was going through a very stressful situation last year. At 2:30am, Johnny called me and talked to me untill I calmed down.He went above and beyond the call of duty,not only for me but hundreds of people that I have talked to. After 20 years as an outstanding police officer in Bryan Co.,he screws up(because of an addiction)and yall want to crucify him.Everyone should be entitled to one mistake.Yea, he is a police officer but above that he is a human being and one hell of a man!!!Johnny,Sandy and kids,Hang in there!Yall have hundreds of people in Bryan Co.that are proud to stand in your corner and even prouder to call you friend! P.S.People who live in glass houses shouldn't throw stones!!!!

I only have one comment and it is that alot of people are good people that get into trouble. BUT the system DOES NOT treat them the same. That is my problem with this. WE are all equal before the law. HA HA Anyone else would have spent time in jail before getting a bail amount. And would spend time for this. Every law enforcement needs to be on the other side of the fence at least once, we might have better law enforcement. We have too many given special treatment and too many given extra hard punishment. If you have nothing and are no one special you get more than if you are somebody and have something. I pray for this family and for Johnny - may this make him a better person and get him the help he needs. I also pray for every mother, wife, child of good people who take a wrong turn and have to go thru this ordeal, it lastes along time and the pain stays forever and most people will never give you a new chance to show you are good, oh they will you but not the normal good person.

Hey you know who else needs to get punished in this whole thing. The doctor who prescribed these drugs in apparently to high of dosage to cause him to get addicted in the first place. Thats the bad thing with prescription drugs is you don't realize your addicted until you stop taking them and you can't. Johnny, Sandy and kids your in my prayers. I have no sympathies for this officer turn criminal. He is a criminal now and should be treated as such. He needs to be put in prison so he can face his problems and be rehabilitated there like any common criminal. But I can assume his buddy officers and prosecutors will get him the softess punishment as possible!

I would like to say that I'm praying for the victim in this story...the owners of Morrison Drug Store. As a business owner, I know what it is like to be burglarized by thieves. I have never seen such sympathy for a law breaker. I honestly don't think you folks would be so understanding if it were your business that this happened to. We all have suffered loss. His losses are no more nor no less than a lot of folks. They don't go burglarizing their neighbors when times get tough. I wonder how many of his "friends" he also stole from?

Johnny still is a good person. He has admitted to what he did and turned himself in to the authorities. He is doing all he can do to settle this. Clearly he was under the influence of an addiction. I would just like to say that I have known Johnny all of my life and I am totally shocked just like everyone else. I want the family to know that they are in my thoughts and prayers. If you have never dealt with a loved one who has had an addiction, you have no idea. People you would never believe get hooked and it destroys everyone and everything around them so please if you are one of those fortunate few who have never dealt with this, please don't be so quick to judge. I agree that he should be punished but if he was just the average citizen, we probably wouldn't have heard about this. I realize that police officers are here to serve and protect but they are humans too and I know this has to be very difficult on his fellow officers/friends.

I've had my own share of ups and downs and have made some really dumb decisions. I have picked up and carried on with God holding my hand. I recall you coming by to check on me and leaving your card on my door when I was going through a tough time in my life. I really appreciated that gesture. Many people in Bryan County were kind and helped me get through a difficult time in my life, but there were also those that looked down at me. I work for an attorney and i just thought mrs. rutherford might need to take into consideration anything she says on here can be used against her husband and it might not be a good idea for her or her family to be posting anything on this website or any for that matter while this situation is still pending it can only be used against him in a court of law, it is better to ignore what other people think and what they say then to inflame the situation and make it tens time worse.

Maybe some of you posting on this website should look around Durant and see the difference Johnny made to Durant. Maybe you should not judge someone until you walked in their shoes. I am sure that all of you have something in your past that you are not proud of. Think about how you and your family would feel if KXII and Durant Democrat had you on the front page. Johnny is a wonderful friend, husband, and father. As an officer stated earlier, maybe if we had all listen to Johnny and paid closer attention we would have noticed he needed help and was struggling with his grief and the stress of his job. How many of you could call a friend and let them know a family member was found dead? I look back and remember a conversation Johnny and I had and wished I had reached out then; however, I thought he will call if he needs help. Don’t judge. Offer help, prayers, and love. I'm quite sure if your son, daughter, husband, wife, or anyone else in your family were in this situation you wouldn't be so quick to judge. Johnny is one of my favorite people who I have a lot of respect for (yes, I still do). There are a lot of things that make up a person & I don't think one bad choice is enough to condemn them. Johnny has seen a lot, he's seen a lot of people hurt in his line of work.. one of those people was one of my good friends & he did everything he could to help her out & succeeded. I know if I had seen half the stuff he has seen I would have some sort of problem. Whether it be an addiction or mental illness. People take for granted what the men & women in the police force do so we don't have to. I'm not saying that it makes them innocent or any less guilty, but I would be surprised if a lot of people in that line of work don't have some sort of problem. Johnny is a good man, & I will stand beside him & his family no matter what. Because they need support.

Look he got on drugs, became addicted to drugs, I did not see anywhere where he asked for help, before or after this became a big problem. Look the guy has a drug problem, but that is no excuse to steal from a business he was to protect. lets go easy on him? not on your life... drugs or not drugs.. It was a choice he had, to steal or not, to ask for help or not to ask for help. A drug addict is a threat to the community, as they will do anything for drugs, lets take this as an what If.. What if someone was in the building at the time he broke in, would he think twice to kill this person.? after all someone that is an addict will do anything for their drugs. and how many people are killed in the USA for drugs every day? So dont' ask for pity with me.

Complex?...a sworn law enforcement officer is caught on video committing a felony, confesses to it and several others. Sounds pretty simple to me...and his occupation gives a black eye to every other cop in Oklahoma...and everywhere else, for that matter.

It is so easy to be the judge on here.. Its not like we are talking about a repeat offender here! Johnny is a wonderful man. He has done great things for the community, I have known him all my life and was friends with his sister. This is a perfect example of how drugs can take ahold of anybody, no matter what platform you put a person on..yes he is held to a higher standard because he is a police officer, but we want to pretend like these people are not human.. YOU KNOW, people can be put on medications for illness or injury and before they know it their body is hooked without their purposeful intent...It just goes to show you how drugs can bring the strongest and best to their knees, and yes, I wish someone could have noticed the warning signs before it got this far..Johnny,God will hold your hand and help you through this.. I ALSO PRAY FOR YOU PEOPLE ON HERE WHO ARE SO MEAN AND NASTY, PRAY THIS DOSEN'T HAPPEN TO SOMEONE YOU LOVE....

being quick to judge? come on. really? caught on camera..confessed. guilty to me. so hard times gives you the right to break the law? he should be punished just like every other criminal out there.

Police offices are not immune from addiction problems. If Mr. Rutherford is guilty then he will most certainly be punished and, if the punishment is consistent with other offenders as it should be, he will not be doing jail time. He should receive the same treatment as others in Bryan County and that will mean a chance to go to rehab, to beat his addiction, maybe Drug Court, or some other court ordered treatment program. That is what the courts do for others and it should be offered to the officer. If he is offered those options and is successful in beating his problem, we all win because we won't be paying for his jail time andhe will become a contributing member of society again. We should all be praying that he is successful just like we would for anyone else. Don't give him a break because he is a cop, but don't beat him down worse because of it either. I say give him the same chance as everyone else gets to beat his addiction and go on about his life. I hope he makes it.

People need to step back and look at what the media puts on TV.If it was anybody else would they make such a big deal about it.Look at what Johnny did for the town of Durant.I know Johnny personally and I don't think that hes a bad person for what he did. Nobody knows what's going on with other people's lives. Aren't we taught when we go to church not to judge, looks like people need to step back and take a look at what they are doing/ Your in our prayers Johnny, Sandy and kids

Rutherford was a really great guy i will admit, but in law enforcement we get all kinds of training, we should have been able to see the warning signs and helped him before the incident. If anyone is to blame we should blame us all for not seeing the problem before it happened. this man had done great things for the community and i believe we all should be there beside him defending ourselves for not helping him before it got this far. you cannot keep problems like this from happening or so called "Policeing" if you do not reconize the symptoms Officer

The bleeding hearts club strikes again. I can't believe you people. He needs help alright - a fair trial and punishment if convicted. According to the story he's as good as cooked on this one folks. You see, I'm one of those idiots that support our local law enforcement and I hold them to a higher standard (as they should be) so when they break the law in certain instances they should be held accountable and be punished to the full penalty of their crime. Our prisons and jails are full of "really great guys that just made a mistake". Give me a break. Breath mint anyone?

Hey friend. You say he is not an addict, he is someone who needs help. What is the difference? If he wasn't addicted why else would he break into the pharmacy. I'm not judging by any means. I thought Johnny was one of the few good cops in Durant. But I also know that good people get addicted just as often as bad people. No one has a right to judge someone. Walk a mile in someone elses shoes before you are so quick to put someone else down. My prayers are with you Johnny and Mrs. Johnny and your kids.

That may be true, but how do you call breaking into a drugstore just a "mistake being blown out of proportion"? He made this choice himself, and sadly it does trump 20 years of service to the folks in the area. He does need help to overcome this addiction, but it looks like he has blown his career as a police officer out of the water. No winners in this story any way you look at it.
