Hugo asks judge to keep water lawsuit alive
MUSKOGEE, OK - The city of Hugo is asking a federal judge to keep alive its lawsuit challenging the state's moratorium on selling water out of state.

MUSKOGEE, Okla. (AP) - The city of Hugo is asking a federal judge to keep alive its lawsuit challenging the state's moratorium on selling water out of state.
The city wants to sell water to Irving, Texas, based in part on a pending permit application to take 65 billion gallons of water a year from below Hugo Lake.
The state attorney general's office says that permit application is "deemed withdrawn" because the city didn't file for an extension within three years - as required.
Hugo City Manager David Rawls says state officials met with city officials during the spring and never mentioned that the permit was considered withdrawn.
The moratorium was adopted in 2002 during negotiations by then-Gov. Frank Keating's administration to sell water to Texas.
The moratorium is set to expire in late 2009.
