GAINESVILLE, Tex. -- Record breaking identity theft numbers have hit Texoma, and the city of Gainesville has seen a drastic increase, where bank officials say one restaurant has over 400 people left without debit cards. Rashi Vats explains.

Gainesville police say there have been over 30 cases of identity theft in just the past month, and one restaurant in Gainesville has put about 400 customers in danger of being victims of identity theft.

It’s the rumor going around town.

"I heard that some guy used his debit card at Golden Chick and supposedly about $400 was taken out of his account," Maegan Puetz told us.

So instead of going to Golden Chick, Maegan and her friend, Ellanie, went somewhere else to eat, because, as we learned Tuesday, one Gainesville bank's officials say Golden Chick has been a place where 400 of its customers were in danger of identity theft between October and mid-November.

First State Bank in Gainesville received a number of phone calls from their customers about transactions they never made. It turned out they were victims of fraud.

"What we understand would have happened is someone who would frequent the restaurant on a particular day, their card information was also captured, and basically the magnetic strip, and they reproduced the plastic with that magnetic strip information on it, and then used it and other locations, creating fraudulent transactions," says Tim Turbeville, Senior VP at First State Bank of Gainesville.

First State Bank then investigated all of their customers’ accounts and found there were more people in danger than they expected.

"We had a list of accounts that reported the fraud, so we pulled transactions back from an earlier point in time, and we noticed that a common denominator that all these customers went to Golden Chick," Turbeville says.

Now First State Bank is taking a proactive approach by currently notifying those 400 customers and issuing new debit cards.

Golden Chick goes owner Dee Lee says she gave the Gainesville Police Department surveillance video, and they found nothing connected to the restaurant.

"We gave them the video, and nothing was connected to Golden Chick, but the only thing connecting them is the people that were compromised have purchased from the establishment…We want Golden Chick to be the safest place in Gainesville," Lee said in a statement to KXII-TV.

But all the people that were affected did purchase from the establishment. They have ordered more cameras that will be installed this week, and say they want Golden Chick to be the safest place in Gainesville.

But for those 400 people, Golden Chick wasn't a safe place, and Gainesville police are still investigating. They say that most of the cases reported were stolen from debit cards, and that many of the charges have been made out of state in California or Florida.

If you feel you are a victim of identity theft, experts recommend you contact the police immediately.

To Teri, Staci, and the rest who are clueless: First, Teri, your question of "How would people at Golden Chick make purchases in other states?" tells me that you're an idiot. The employees aren't the one's making the purchases, they're the one's skimming the cards and sendng the info to theives in other states. As for the 12 or 13 cases... way off. There's hundreds and they all went to Golden Chick. That number "400" floating around is just the number of cases that FSB has reported. The other banks probably have their own cases. Whether it's the Lee family or not, one or more employees at Golden Chick are the source for all this identity theft and they either need to get rid of the problem(s), or risk losing local business and getting shut down. I'll never go there, and I'm spreading the word not to.

Lou your an idiot. Debit/Check cards are one of the greatest additions to currency. You think you are special because you use your Credit Card. Go ahead, rack up those points. That $5 gift card that you get with your points will probably end up costing you $1000.00 worth of points not to mention the interst rates. What makes credit cards any different when it comes to saftey? You think you have the right idea....good luck getting your money back from fradulent charges. Banks are WAY easier to get help from. Just wait, you keep using that credit card, you are a classic case of identity theft waiting to happen.

For safety's sake, I only use my ATM/debit card at ATM machines, NEVER as a debit card. Why do it when I have a credit card with a neat point reward system that I pay the balance each month? Using a debit card amounts to paying a credit card balance in full each month, plus you get to hang on to the money longer. Forgive this lecture from a former teacher.

Why do you think they call the place "Golden" Chick???

Dear Okie, How do I know you dont know Mr Turbeville? Because you cant even spell his name correctly. Leave it an Okie.

Whatever happened to cash?

Posted by: Lil O Me Location: Texoma on Dec 5, 2008 at 01:32 PM
I have never used a debit card and never will. Besides it's much more fun to make them run my check through their little scanner or make them write down my DOB and driver's license while the people behind me are jumping up and down because they are in a super hurry...I just LOVE IT!

Posted by: Anonymous on Dec 5, 2008 at 12:04 PM
Im guessing would be employees of the chicken place.

Dear Anonymous on Dec 5, 2008 at 08:22 AM, Oh - touched a nerve did I? Just how do you know that I do not know Mr. Turbville? Have a good weekend!

Posted by: JLK Location: Dnison on Dec 5, 2008 at 09:00 AM
They just need the number off the card to reprodice another one with the magnetic strip and to sell it , use it or whatever they want to do with it. They can tap into the store own camera system to get a feed and capture the numbers. They can use their cell phones, there are even these little cameras that fit on your own glasses that are not even noticable that are on sale online, cheap. There are 100's of ways to get that information now days. go online look around you'll get shocked at what you can find.

Posted by: Anonymous on Dec 5, 2008 at 08:22 AM
Dear Okie, Seeing as you dont know Mr Turbeville personally why dont you have a drum stick and shut the hell up.

Posted by: Okie Location: Oklahoma on Dec 4, 2008 at 03:26 PM
So, this entire story hinges on ""Bank links multiple identity theft cases to Gainesville restaurant"". We only take the word of the bank? Don't we have - Oh let's see, FBI, Texas Rangers and such as that to investigate things like this? Or, we just blindly take the word of ""Tim Turbeville, Senior VP at First State Bank of Gainesville."" You will never convience that with all those people none of them haven't been to Wal-Mart. For crying out loud. I have never eaten at Golden Chick - don't know the owners, either, but I am not blindly going to take the word of the all-mighty bank (as honest as they are)who have people coming in wanting answers of how their personal bank accounts have been compomised. The bank is feeling the heat - and now want to get the fingers pointing in another direction. I hope all og the peolple get their accounts straightened out.

We are doing everything possible to make sure you card is never out of your site and after this week out of your hand by installing self swipe machines as the news has said i am on my second set of cameras an nothing has been found to be abnormal in Golden Chick. We are a new store so alot of people have visited but mamy people have called to let me know their cards have been misused and never used it at Golden Chick. I ask everyone to lease watch your card at all times not only at Golden Chick an my prayer is that whereever this is happening the bank that was quick to say it was our fault or somewhere else I want this fixed so we can all feel safer. Thank all of you that have given my family support and I will shout it from the roof top when they finally figure out where this terrible crime is coming from.I am working closely with our police and sherrif Depts. to aid in this any possibke way I can. I DON'T LIKE CHICKEN

Posted by: Staci Location: Whitesboro on Dec 4, 2008 at 12:58 PM
am in that location on a daily basis, There are other common factors in this case. I use my debit/Credit card in there every time. I have not ever had a problem with my card. The Lee Family is not guilty of this. They are a Christian family that wanted to do something good for Gainesville. How is it possible to make a copy of a magnetic strip on the back of the card. Think about what you said.

Posted by: So sad Location: gainesville on Dec 4, 2008 at 10:32 AM
My relative was one of the persons who card info was stolen. over $900!! It was myunderstandin that they make a copy of the magnetic strip, put iit on a plasic card and sell them over the internet to people. the card was used in California at walmart and a gas station. They are not making purchases over the internet. Why cant people just get a job and make money the way it should be made. Thiefs are scum bags!!!!!!!!

i miss you klk

Even if the purchases weren't made online, they can get the billing address from the bank, trace the purchase address back and then get the shipping address from the vendor. Like some else said, stake out the address and watch and see. The chicken place my just be as innocent as the other victims, and it could be a employee that has them all fooled. you never know.

Suddenly, I have me a craving for some fried chicken. Anybody know of a place where I can get some?

Posted by: Anonymous Location: Texas on Dec 3, 2008 at 02:23 PM
only 12 peoples identities were stolen in the past month? I believe the Gainesville newspaper said Gainesville PD was investigating 30 cases alone, not counting the Cooke County Sheriff's Office cases.

Posted by: KLK on Dec 3, 2008 at 02:15 PM
This has been going on for months. I received an email about it in early Oct. Catch up people, this should have been reported a long time ago to the general public

Posted by: Anonymous on Dec 3, 2008 at 02:11 PM
So its not the chicken places fault but thats where it all happened??? Sounds like it to me.

Posted by: Anonymous Location: g-ville on Dec 3, 2008 at 02:09 PM
Ok it would not be that hard for an employee to get someone info from a debit card or even the next person inline behind you. It happens every year at this time. Everyone has picture phone now days, you can easily take a pic of the card as someone is pulling it out and then watch as they enter their pin number. WOW that made me sound like a criminal, but I'm not I have worked with a few though.

Posted by: Red Location: Sherman on Dec 3, 2008 at 01:44 PM
Don’t blame Golden Chick. Gainesville is full of crank junkies and other assorted criminal types that will happily steal your credit card number.

Posted by: Jane Location: Oklahoma (former Gainesvile) on Dec 3, 2008 at 01:39 PM
Ok there are OTHER banks that are having the issue just because you love your fast food restraunt doesnt mean something shady isn't going on. Before you post a comment read what other people wrote too. Yea it does seem really unlikely that it would happen but it does. It happens every day! And as for "Oh its a debit card it says debit card so its only a debit card!" WELL as long as you have that little Visa or Mastercard etc on the front of your "debit card" when you swipe it all you have to do is hit cancel and it gives you an option for credit card. Yea I'm sorry it happened to Golden Chick but it happens folks no matter how small of a town Gainesville is not everyone is who they seem!

Posted by: anonymous Location: anonymous on Dec 3, 2008 at 01:20 PM
Maybe the bank is to blame. They are making it sound worse than it actually is. Only 12 peoples identities were stolen in the past month. 400 people have the common demoninator of using First State Bank and using their cards at Golden Chick. As soon as the word got out about this scam, those 400 people wanted to protect themselves from their identity being stolen. Which there is nothing wrong with taking nessicary precautions. But dont over exxagerate the story and make it sound like 400 people are victims here. I personally know the owners and their family and they do everything in their power to make sure they are the safest and most secure place in gainesville. Instead of pointing fingers, someone should do their research. Its such a shame that the city of gainesville can downgrade a bussiness that has helped the community prosper. Shame on you all. May God bless the Lee family and all the employees and help them thru this difficult time.

Curious, I doubt very seriously that anyone could tap a data stream going over a copper phone line, but anything seems possible nowadays...

Posted by: Anonymous Location: Gainesville on Dec 3, 2008 at 11:28 AM
To Carlos, it does not say the purchases were made online. I think some people watch too much TV and think every crime is simple to solve.

Posted by: Staci Location: Whitesboro on Dec 3, 2008 at 11:21 AM
The other common factor is the bank.. Is anyone looking there. I use my card in Golden Chick on a regular basis. I have not ever had a problem. Are you going to go and appolized for the slander when it is proven not to be Golden Chicks fault.

♫ "...It's all so-o-o good!" ♫

Posted by: Anonymous on Dec 3, 2008 at 10:32 AM
You do not have to use your PIN number at a restaurant or grocery store for a debit card. You only have to use it at an ATM. Even if you put in your PIN number every time at the grocery store all you have to do is sign for it to make a purchase and not even that, online.

Posted by: CARLOS Location: GAINESVILLE on Dec 3, 2008 at 09:54 AM
THE BANK OR THE POLICE SHOULD CONTACT CALIFORNIA WHERE ITEMS WERE BOUGHT AND GET A SHIP TO ADDRESS. WATCH WHO LIVES THERE AND YOU GOT EM SEEMS SIMPLE TO ME

Posted by: TJ Location: Gainesville on Dec 3, 2008 at 09:43 AM
I use another bank Teri and it happened to me to the tune of almost $500.00. My banker told me it is happening to account holders at ALL banks in Gainesville, Texas so it's not linked to the bank.

Posted by: Anonymous on Dec 3, 2008 at 09:30 AM
Cash sounds better these days!

Posted by: Curious Location: Oklahoma on Dec 3, 2008 at 08:59 AM
Could someone have tapped their telephone line the credit card machine runs on?

Posted by: Futz on Dec 3, 2008 at 08:59 AM
It was either an employee, or Kool-Aid Man.

Posted by: Teri Location: Gainesville,Texas on Dec 3, 2008 at 08:41 AM
All of this identity theft sounds like it is all linked to the bank. How is it that all of the 400 plus customers are all from First State Bank and not from any other bank? How would the bank know that other people were in danger. You would not know this if it was happening at Golden Chick. Surely not everyone that is going to Golden Chick is a First State Bank customer. If it was coming from them wouldn't other people from other banks be in danger too? It sounds like to me that someone has broken into the banks system and stole information from peoples bank accounts. I am a customer of First State Bank, I also have a debit card and when I use it I have to use a pin code. So how is this possible unless it is coming from the bank? The charges to peoples debit cards are in California and Flordia. How would people at Golden Chick make purchases in other states?
