HOWE, TX ― A Howe gym owner was arrested Tuesday morning for possession of a controlled substance and public intoxication.
Heath Garrett Horton, 27, the owner of Number One Fitness on Haning Street, was arrested at his home by Howe Police late Monday night.
Howe Police were responding to a separate call at the fitness center when Horton drove up to them, allegedly intoxicated, early Tuesday morning.
After searching Horton’s residence later, police found more controlled substances. Howe Police say charges for those substances will be filed at a later time.
First News received a statement from Horton’s attorney, Micah Belden, acknowledging the charges against Mr. Horton in which he apologizes to members of his gym and the local community for any lapse in judgment.
"It is true that Mr. Horton was arrested in his driveway at his residence on April 14th, 2009 for suspicion of public intoxication and suspicion of misdemeanor possession of prescription pills which are labeled under Texas Law as Controlled Substance Penalty III. Mr. Horton apologizes to members of his gym and the local community for any lapse in judgment."
Horton was taken to the Grayson County Jail, where he has since bonded out.
The gym was closed for a time Tuesday, but has since reopened to members.
