Arbuckle-Simpson aquifer trial date set

JOHNSTON COUNTY, Okla. – The state of Oklahoma is trying to keep a Texas-based mining company from pumping more water from the Arbuckle-Simpson aquifer.

The State Attorney General's Office plans to enter a civil case against Martin Marietta Materials to defend the constitutionality of a law banning water transfer from the aquifer in Johnston County.

Last year the Oklahoma Water Resources Board granted the company a permit to remove close to 90 million gallons of water from the aquifer.

The company asked for five times that much and is now questioning whether the board had authority to grant or reject the permit.

The trial is set to begin June 5th.
