Death Sentence Overturned for 2nd Time

DENVER (AP) -- A convicted killer's death sentence is being
overturned for the second time. A federal appeals court in Denver is overturning the death sentence of Mark David Johnson. The court says the prosecutor and judge in the case were wrong to tell the jury that a prison sentence for Johnson could be commuted.

Johnson was convicted and sentenced to death for the 1991 murder
of Billy Wayne Webb, who was beaten and set on fire near Marietta.

The appeals court threw out Johnson's first death sentence three
years ago.
