Contested case hearing set regarding proposed Cooke Co. sand mine

GAINESVILLE, TX-People in Cooke county voiced their concerns about a proposed sand mine near the Red River Wednesday night. Now, a contested case hearing has been set, so a judge will ultimately decide whether or not it will be built.
At Thursday's preliminary hearing, all four parties concerned picked someone to represent them during the case. Standards of Administrative Hearing judges presided over today's hearing at the Cooke County Courthouse Annex. More than 70 people showed up.
Enron Oil and Gas is applying for an air quality permit with the TCEQ, allowing them to build and operate a sandmine along FM 373 near the Red River.

"We are an affected party and this affects us negatively. It affects our health, it affects our water, it affects our quality of life. It affects all of these things," said resident, Ozlem Altiok.

"The SOAH takes jurisdiction and they will name the parties and set a procedural schedule for a hearing on the merits, which is similar to a hearing in district court," said TCEQ attorney, Betsy Peticolas.

The actual contested case hearing is set for April 2013.
