GAINESVILLE, TX -- A jury has indicted a Gainesville man for capital murder.
Cooke County DA Janice Warder says the elevated capital murder charge for Johnny Earl Alexander stems from new details that emerged during his girlfriend, Catrina Maldonado's trial last month.
Alexander is accused of causing burns to more than 60 percent of Nathan De Alejandro's body in 2011.
The 4-year-old died two weeks later at his home after authorities say Alexander, Maldonado, and Alexander's parents did not get the boy any treatment.
A jury sentenced Maldonado to life in prison.
Johnny Lee and Matilde Alexander are serving eight years in prison.
