DENISON, TX - The man was accused of shooting and killing another man and his dog near a Denison golf course last year, was found dead in his home last night.

53 year old Robert McInchak was found dead inside his home on Golf Walk Circle in Denison Sunday night.

"Sad ending to a sad situation, nobody's happy about things like that, did let the family of the victim of the criminal case know, and it's just a tragedy all around." said District Attorney, Joe Brown.

Investigators say around 7:45 Sunday night they got a call from a family member concerned about McInchak, saying they had received a strange text.
When deputies went to check on him, no one answered the door.

"Tried to get someone to come to the door, all the doors were locked, we were able to look through a window and see that there was a white male sitting in a rather large chair in the master bedroom." said Sheriff Keith Gary.

Sheriff Keith Gary tells us a family member showed up with a key, and once inside they found McInchak dead in that chair.
He had shot himself.

"It was a gun shot wound to the body, it was an unusual place, it was not to the head, it was to another part of his body, probably in the sternum area." said Sheriff Gary.

McInchak was charged in the shooting death of 58 year old Shellman Smith Jr. last year in April.

"This was his first time in the system, you're looking at a serious 1st degree murder charge and the possibility of life in prison, these are things that sometimes happen." said Brown.

Prosecutors say, last April, while Smith was playing golf at the Denison country club, his dog wandered into McInshack's yard.
The two men got into an argument and McInchak shot the dog, then Smith with a 22-caliber rifle.
His trial was set to start Monday.

"Obviously there can't be a criminal case, so the charges will be dismissed, so there is no good ending, and no rational explanation for these things." Brown said.

First off let me say that the families are all suffering> But I will also say a dog ran on his property, then the owner came to get his dog and told the man he was sorry, and the the owner of the property shot the dog, the the other ask why did you shot my dog, words was passed and then he shot the other. Why would someone shot a dog and then shot a person Because he was depressed bulllll crrrraaaappp I will say this he shot his self in the stomach from what I hear and if he was that depressed and mental he would have shot his self in the head! But he didnt shot his self in the stomach maybe he didnt mean to kill hiself maybe he was trying to buy time being his court date was the next day. But he wanted to die he knew he was going to prison and he knew he wouldnt get the " I have a Mental issue" And all this gun talk you can buy a gun anywhere anytime on these streets. And I will tell ya sometimes its good to have one but sometimes they will get you in trouble!

Why is it that every time anyone mentions gun safety or tighter gun control to keep guns out of the hands of criminals and crazy people, the NRA worshipers start talking about someone "taking" out guns? Are they really that stupid? No matter how many scary "what ifs" the gun lobby puts into their tiny, empty heads, no one is ever going to come and take our guns. Not today. Not tomorrow. Not ever. There aren't enough anti-gun people who don't want to be re-elected in all of Congress, to come even close to passing any kind of gun confiscation law. It is beyond stupid to even think there is a chance of that. They are simply showing how easy it is to scare morons into believing any far fetched BS that they can come up with. I own lots of guns. I've had a CCL for several years. I'm not the least bit scared. And I am certainly not stupid enough to give my hard earned money to a bunch of liars and nut-jobs at the NRA. The way things are going, if I ever need to use deadly force against anyone with my concealed weapon, it will probably be a wacko gun nut trying to be a hero by shooting anyone who looks like they may be a threat. All you scared stupid folks who let politicians and the gun lobby that pays them, are the reason my ammo prices have skyrocketed. Your crazy fears are a blessing to the gun & ammo industries. And one day your crazy fears might get you blown away.

Yes. Some words of sanity in response to a story and some comments that scream insanity.

Bill. You might want to check out the local Democratic platform. All about gun control, but you probably already knew that. Proabably sitting next to Bea. They are just going to regulate guns and ammo out of use. Wish you wanted the next generation to have the rights and freedoms you enjoyed. If those before you had your attitude, you would not be enjoying the freedoms you are now.

since you know what will or will not happen in the future concerning the right to bear arms, this makes you a prophet. it must feel good to know it all. how many fingers am i holding up?

My condonlences to both families. As to the gun comments, criminals and other desperate persons will get guns, even if law abiding citizens turn their's in. This man was on a specific release that prohibited him from having guns. His possession and use of a gun in his suicide is just final proof that gun control does not work.

He looks so happy with his wife, I thought someone mentioned she had recently passed, before the incident at the golf course, this man was more than likely depressed, and a depressed person with access to a gun very possibly would take this route. The NRA advocates will jump on this but everyone does not need a gun, they take their lives instead of reaching out for hope, they kill children with skittles in their pockets.....

Let's not forget this whole thing started from a dog not being under physical control of it's owner. This is an uncalled for event, as was the attack in Mead. The lack of common sense is alarming! I think the solution is beyond education and law. Both of these men knew better than their actions demonstrate.

Pete,What does the NRA or the gun have to do with this, the guy did not want to go to prison, if he did not have a gun he would take sleeping pills or some other way to stay out.

Jerry it could be explained to you about a dozen times and you still would not understand it. He shot the dog with a gun,he shot the golfer with a gun he shot his self with a gun. He was a nut with a gun. Nuts don't need guns.

So, let's take away guns; enforce greater gun control. I think the "nuts" would be the first to volunteer their guns, right?

Just maybe someone else did the shooting, investigators at the S.O. can't investigate any crime scene without "daddy Rains" there to put his finger in the pot, ha a play on words.
