Texas man who set ex-girlfriend on fire set to die

HUNTSVILLE, Texas (AP) - A federal appeals court has refused to halt the scheduled Thursday evening execution of a Texas man convicted of killing his ex-girlfriend by tossing a cup of gasoline on her and then setting her on fire.

The New Orleans-based 5th U.S. Circuit Court of Appeals, in a brief ruling Wednesday evening, rejected an appeal filed by an attorney for 48-year-old Carl Blue.

Blue faces lethal injection in Huntsville for the 1994 attack that killed 38-year-old Carmen Richards-Sanders at her apartment in Bryan.

Blue's lawyer, Michael Charlton, says he's taking Blue's appeal to the U.S. Supreme Court.
