GAINESVILLE, TX -- The jury heard testimony from the prosecution Wednesday in the trial of a Gainesville man charged in the death of his girlfriend's son.
Johnny Earl Alexander was indicted for capital murder in October, but the Cooke County District Attorney's Office says a judge is trying Alexander for first degree injury to a child, not capital murder.
He's accused of causing burns to more than 60 percent of Nathan De Alejandro's body in 2011.
Authorities say the 4-year-old was never brought in for medical treatment and died two weeks later.
Nathan's mother, Catrina Maldonado was already sentenced to life in prison.
Johnny Earl Alexander's parents, Johnny Lee and Matilde Alexander, are serving eight years in prison.
The case is expected to continue Thursday. Alexander faces 15 years to life in prison if convicted.
