4-3-06 - After four hours of deliberations, the jury in the Miroslaw Jozwiak trial sentenced the truck driver to ten years in prison and a 60 thousand dollar fine. Jozwiak faced up to 20 years in prison for the September 2004 wreck that killed 10 people on Highway 75 in Sherman.
Testimony in the sentencing phase wrapped up Monday afternoon with Jozwiak as the final witness.
The twelve men and women determine the punishment on 12 separate charges. Jozwiak pled guilty to ten counts of manslaughter and two counts of aggravated assault for causing the wreck on Highway 75 in Sherman in September of 2004.
Ten people died in the wreck and Jozwiak has been in jail since then. He took the stand today, answering questions about medication found in his briefcase, his level of fatigue, and whether he remembered what happened just before the wreck. Jozwiak answered questions through an interpreter, as he became very emotional specifically when asked what he saw at the accident scene.
Just before testimony ended Jozwiak asked to make a statement to the court. He said to the family of the victims, “I’m very sorry about what happened and I will have this for the rest of my life.” The courtroom was very quiet for several seconds, then the defense stood up and rested their case.
