COMMERCE, TX - Commerce Police identify the gunman in yesterday's Wal-Mart shoot out that ended in the death of the shooter. Police say 29-year-old Artenio Rodriguez from Commerce was the gunman who shot an off-duty sheriff deputy.

That Delta County Deputy, Paul Robertson, was shot in the chest yesterday as he exchanged gunfire with Rodriguez. Robertson is now hailed as a hero for trying to stop Rodriguez.

Police say he identified himself as law enforcement and ordered Rodriguez to drop his weapons. Authorities say they're unsure whether Robertson or Commerce police fired the shots that killed Rodriguez.

Robertson was released from the hospital and in stable condition.
