Arrests made, details released in Whitewright murder

SHERMAN, TX--The Grayson County Sheriff's Office tells KXII a shooting Saturday night was the end result from an argument over a $30 donkey. Now one man is dead, another is in the hospital, and 4 others are in jail.
On Monday morning investigators with the Grayson County Sheriff's Office packed up evidence from the crime scene to be shipped off to the DPS Crime Lab for further analysis. Sergeant Rickey Wheeler tells KXII that the shooting took place Saturday night just before 11:30. Wheeler says 29-year old Octavio Cruz was shot twice and received non-life threatening injuries and remains in a Dallas hospital.
Investigators say Sergio Cruz allegedly shot 49-year old Guadalupe Pena, of Mexico. Pena was shot in the upper torso. He later died at Texas Health Presbyterian Hospital-WNJ.
Wheeler says Sergio was not happy about the purchase of the donkey and wanted his money back. A fight then ensued, followed by gunfire. Alcohol is also believed to be a factor.
“There was no need for the confrontation to start with. It's one of those things when alcohol is involved, parties don't make good decisions,” says Wheeler.
Murder suspect Sergio Cruz remains in the Grayson County Jail. His bond has been set at $500,000. Sheriff's Investigators tell us he was found in Fannin County, where they also recovered two riffles.

At 11:27 a.m. Saturday night the Grayson County Sheriff’s Office received a 911 call from 98 Kelli Road just south of Whitewright. The caller stated that a man had been shot in the chest; Whitewright EMS and Grayson County Deputies were dispatched to the scene. Whitewright EMS staged at the Bethel Baptist Church until the scene was safe and secured by Grayson County Deputies.
Once on the scene deputies reported state that one male subject (Guadalupe Pena) was the victim of a gunshot wound to the upper torso. Pena was transported to Wilson N Jones by ambulance where he later died from the wound he sustained. Guadalupe Pena was a 49 year old man from Mexico; Pena lived at the home where the shooting occurred.
A second shooting victim arrived at Wilson N Jones emergency room by personal vehicle just after midnight. This victim was identified as Octavio Cruz a 29 year old man who lived and worked in Whitewright. Cruz had suffered two separate gunshot wounds; one to his upper chest and the second wound to his left hip. Cruz was later transported to Dallas Methodist Hospital with non life threatening injuries.
Grayson County Investigators Chad Butler, Harvey Smitherman and Sgt. Rickey Wheeler were notified and dispatched to various locations. Inv. Butler and Texas Ranger McNeal went to the scene on Kelli Road to begin the task of collecting evidence and taking statements. Inv. Smitherman and Sgt. Wheeler went to Wilson N Jones hospital to take statements, collect evidence and check on the shooting victims.
As Investigators pieced together the events of that night they learned that two brothers, Octavio Cruz and Sergio Cruz went to 98 Kelli Road to confront an individual in regards to a donkey that was sold. When Octavio Cruz and Sergio Cruz arrived there was an altercation between Sergio Cruz and Guadalupe Pena. While the fight between Sergio Cruz and Pena was going on another man, Rodolfo Garcia pulled a pistol and shot Octavio Cruz. Sergio Cruz ran to his vehicle, pulled a rifle from the cab and fired one shot at Guadalupe Pena, striking him in the right side causing his death.
Sergio Cruz and Octavio Cruz fled the scene in their vehicle; Octavio Cruz was dropped off at a home in Whitewright where he found a third party to take him to the hospital.
Sergio Cruz was later located on a farm in Fannin County where he surrendered to Investigator Butler and Ranger McNeal. Two rifles were recovered at that location and placed into evidence. Sergio Cruz was booked into the Grayson County Jail and charged with Murder. His bond is set at $500,000.00.
Rodolfo Garcia of Whitewright was arrested and booked in for Aggravated Assault with a Deadly Weapon in the shooting of Octavio Cruz. His bond was set at $50,000.00.
Brothers Adolfo Pena and Uriel Pena were at the scene when the shooting occurred and helped hide the two pistols. Those pistols were later recovered at a home in Tom Bean, Texas.
Adolfo Pena of Tom Bean, Texas was charged booked into the Grayson County Jail and charged with Tampering with Evidence his bond was set at $1,500.00.
Uriel Pena of Tom Bean, Texas was charged with Tampering with Evidence and his bond was set at $50,000.00.
Investigators could be filing additional charges in this case. One other arrest is pending and is expect in the future.
