FANNIN COUNTY, TX - Last year the Texas Court of Criminal Appeals overturned a murder conviction and life sentence for a Bonham man in the 2008 death of a toddler.
Tuesday that court denied Fannin County's motion for a rehearing.
Criminal District Attorney Richard Glaser says his office is now waiting for a mandate to be issued so that 43-year-old Cory Don Louis can be tried again for the murder of two-year-old Chase Matthews.
The boy's mother Danielle Denise Cuba is serving 50 years in prison for her role in her son's death.
Louis is currently in state prison on previous robbery and drug convictions and was recently denied parole.
