Robert Gray Jr. to face jury's decision after state and defense rest case

GRAYSON COUNTY,TX -- The prosecution and defense have rested their case in the murder trial of Robert Gray Jr.

Robert Gray himself had an opportunity late this afternoon to take the stand, but declined. Now his fate rests in the hands of the jury.

51-year-old Robert Gray is standing trial for the murder of his girlfriend's 15-year-old Autistic son, Brandon White, at their Denison home last January.

Defense witnesses testified today that White died from a severe seizure disorder.

A state medical examiner testified earlier in the trial that an autopsy indicated Brandon was murdered by Positional Asphyxiation.

After discussing it for several minutes with his attorney, Gray eventually decided not to testify this afternoon.

"Every defendant has the constitutional right not to testify. They also have the right to testify if they so choose," said Assistant District Attorney Matt Johnson.

Both sides will make closing arguments tomorrow morning at ten.

If convicted, Gray faces up to life in prison.
