Texas landowner faces TransCanada in court hearing

HOUSTON (AP) - A Texas landowner and TransCanada Corp. are taking their argument over whether tar sands are crude oil before a judge.

Nacogdoches County Court-at-Law Judge Jack Sinz will hear arguments Wednesday. Landowner Michael Bishop wants all pipeline work on his 20-acre property to stop until the judge rules on whether the product TransCanada plans to carry through it is crude oil.

TransCanada's Keystone XL pipeline is meant to transport tar sands - or diluted bitumen - from Alberta to Texas refineries. The section of the pipeline that would cross the international border has not been approved. A shorter portion from Oklahoma to Texas is under construction.

The pipeline is to run across Bishop's land. Bishop says the company lied and that tar sands oil is not crude. TransCanada insists it is.
