Separate trials ordered in Washington Co. case

BARTLESVILLE, Okla. (AP) - A judge has ordered separate trials for a Dewey man and his mother accused in the death of a 15-month-old girl.

The Examiner-Enterprise reports that a judge severed the cases of Marcus Mitchell and his mother, Juanchellee Fitch. The two are charged in the death of Emma Beth Warmberodt.

Authorities began investigating Feb. 24, 2011, after emergency responders found Emma unresponsive at a residence in Dewey. The medical examiner determined she died from blunt chest trauma.

Mitchell was the toddler's stepfather. He's charged with first-degree murder in the toddler's death, while Fitch is charged with child neglect, enabling child abuse and being an accessory after the fact.

Emma's mother, Ashley Mitchell, also faces child abuse and child neglect charges.

Marcus Mitchell is set to go to trial Jan. 28.
