BRYAN, Texas (AP) - The lone defense witness in the trial of a Texas convicted killer charged in a guard's 2007 death says the slaying might not have been intentional.
Closing arguments are scheduled Tuesday in the Bryan capital murder trial of John Falk Jr.
Prosecutors are seeking to have Falk join inmate Jerry Martin on death row over the killing of Officer Susan Canfield during an escape attempt. Martin rammed a truck into the Wynne Unit guard who was on horseback.
The Eagle newspaper reports Falk did not testify. Kelley Adamson, who's an accident reconstructionist, testified Monday that he thinks some vehicle skid marks were already present and the collision might not have been intentional.
Martin was serving 50 years for attempted capital murder. Falk was serving a life term for murder.
