Diplomat: Texas agents should have seen people

McALLEN, Texas (AP) - A Guatemalan diplomat says Texas law enforcement agents were close enough to a pickup truck to see there were people inside before one opened fire, killing two Guatemalan immigrants.

Alba Caceres is Guatemala's consul in McAllen. She said Tuesday that seven survivors say the Texas Department of Public Safety helicopter was 450 to 600 feet away when a trooper inside fired in an attempt to disable the fleeing vehicle.

The shooting happened Thursday when the helicopter was helping pursue a truck near La Joya. The passengers were involved in a failed human smuggling attempt.

DPS has said the helicopter crew believed the truck was carrying a load of drugs, not people.

DPS didn't immediately respond to a message seeking comment.
