Lawsuit sets up test of Texas gun range law

KAUFMAN, Texas (AP) - A pending lawsuit could be the first test of a two-year-old Texas law that's supposed to limit suits against outdoor gun ranges.

The Dallas Morning News reports that a lawsuit filed by Kaufman County District Attorney Mike McLelland alleges that county residents near a range operated by a former Army Ranger are "in immediate risk." The range was shut down after the DA obtained a temporary injunction.

Adam Morgan, who did tours in Iraq and Afghanistan, opened the range on 100 acres of land. He's fighting the DA's suit.

A trial is set for September. It could impact how courts interpret a law designed to prevent nuisance suits against outdoor gun ranges, which often draw complaints from neighbors over noise and safety.

Kaufman is 33 miles southeast of Dallas.
