No ruling in Underwood hearing

Norman, OK -- A judge did not rule Wednesday on a motion to remove the death penalty in the case of Kevin Ray Underwood.

The Purcell man is charged in the 2006 murder of 10-year-old Jamie Rose Bolin in a cannibalistic plot.

Defense Attorneys complained about the leak of a sealed judge's decision in the case, and asked that the death penalty be removed as an option. Another hearing is set for Friday.

Underwood faces first-degree murder charges.

The trial is set to start next week.
