LOVE COUNTY, Okla. -- The re-trial of Ricky Rawlins, Jr. is underway in Marietta. Rawlins was tried and convicted of shooting of a 12-year-old boy in 2004. That decision was appealed and later thrown out on a technicality.

Jacob Ayers, 12, was riding in a vehicle with his parents when he was shot. The boy's mother was attempting to serve Rawlins' younger brother with court papers when the shooting occurred.

Jury selection wrapped up on Monday. Testimonies are to be heard beginning on Tuesday.

First of all the child should have NEVER been there, then he would NOT have gotten shot. So why wasn't the parents charged with neglect. and secondly nobody is dead so how is he a murder? thirdly he did not know the child was in the truck, But the parents did.

Why in the world would a parent take a child to serve court papers? That's not where he should have been. And Rawlins was shooting with intent to kill wasn't he? So technically he is a murderous person. Waste of taxpayer monies.
