Officials with the Texas Commission on Environmental Quality say Rushing Paving Company's permit for a hot-batch asphalt plant has been approved.
The company applied for a standard permit on January 29, and TCEQ officials say the Rushing Paving all the requirements for a standard permit.
The proposed plant caused controversy because of the proposed site is about half a mile from Pottsboro schools.
Residents who live near the proposed site said they'll monitor the area, to try and police air quality levels. Rushing Paving's Teresa Lane plant came under criticism after several complaints and infractions against the site.
Rushing Paving officials denied our request for an interview. They said they have no comment on the situation.
TCEQ officials say opponents to the proposed plant have 30 days to file an appeal with the Travis County District Court in Austin.
