PUSHMATAHA COUNTY, Okla. -- After two years, a former Pushmataha County Sheriff has been arrested and charged with misappropriation of official records.

Elvin Flood, 65, was taken into custody Wednesday night after years of confusion and mistrust.

The Oklahoma Highway Patrol launched the investigation back in February of 2005, after the new and current Sheriff Jimmy Duncan took over and was unable to find hundreds of records-- including that of a very high profile case, missing teen Jeffery Bin.

The highway patrol found those files at a business of former Sheriff Elvin Flood. That's after he told investigators he didn't know where they were.

Over the past two years, OHP has interviewed ninety witnesses trying to find out why the former sheriff kept the files.

Duncan says the previous district attorney, Virginia Sanders, would never issue a warrant for Flood’s arrest and never gave a reason why.

When the new district attorney took office this year, she didn't waste time and issued a long overdue warrant.

We're told Flood has bonded out.

The Pushmataha County Sheriff’s Department says they're glad this investigation has come to an end that Flood’s actions give law enforcement a bad name.

Flood goes back to court next month.

We tried to contact flood late Thursday morning. His wife said he wasn't available and had no comment.
