SHERMAN, TEXAS -- A 22-year-old Sherman man has been indicted for capital murder.
Salvador Martinez Moreno is accused of killing his girlfriend's baby, Max Hernandez, in Sherman on May 13th.
Prosecutor Kerye Ashmore says Moreno's girlfriend left the baby and two toddlers in Moreno's care at their home off Hill Street.
The baby was later taken to a Sherman hospital, then flown to Children's Medical Center, where he died several days later.
Ashmore says the death was caused by shaking, blunt trauma or other means.
Moreno is indicted for capital murder and injury to a child with intent to cause serious bodily or mental injury.
"Originally, the Sherman police department investigated this as an injury to a child, and that's what he was arrested for. Since the child has died from those injuries, then this has become a capital murder case," Ashmore said.
Moreno is being held without bond in the Grayson County Jail on an immigration detainer.
