EL PASO, Texas (AP) - A man shot and killed by a police officer after brandishing a toy gun was struck 12 times, including seven times in the back. That's according to an El Paso Medical Examiner and Forensic Laboratory autopsy report.

Forty-eight-year-old Gregory Smith suffered three gunshot wounds to his left thigh, two in his right buttock and one each in his right shoulder, right forearm and left foot. That's according to the autopsy report obtained by the El Paso Times through the Freedom of Information Act. The newspaper reports that a gunshot wound to the left side of his neck killed him immediately.

An El Paso police spokesman says the shooting occurred in June when El Paso police Officer Matthew Jones fired several rounds after Smith allegedly displayed what later turned out to be a toy gun.

The police spokesman says that right now, their initial investigations show that the officer's actions were justified.

Jones stopped Smith in a motel parking lot. The spokesman says Smith allegedly threatened the policeman, told him he had a handgun and pulled the weapon from his pants.
