7-26-05 - A psychiatrist has found that a former North Texas nurse charged with killing ten patients is competent for trial. When Vickie Dawn Jackson reported hearing voices in May, a judge ordered a psychiatric evaluation.
Two doctors examined Jackson last month, and one submitted her
report this week.
Montague County district attorney Tim Cole expects the same competency finding from the other psychiatrist.
Jackson attorney Bruce Martin says he won't challenge the results for his client, who used to work at Nocona General Hospital.
The defense claims Jackson's mistrial earlier this year was caused by a prosecutor's intentional error. Prosecutors say it was an accident.
A hearing on the double jeopardy issue is set for next month. Jackson, who's maintained her innocence, faces up to life in prison if convicted of capital murder. Prosecutors are not seeking the death penalty.
