ANTLERS, OK - The case against a former Pushmataha County district judge accused of manslaughter is going to an appellate court.

Authorities say 75-year-old Doyle Edward Blythe of Antlers was driving with a suspended license two years ago when six-year-old Riley Harralson rode his bike down a hill and crashed into Blythe's SUV. The accident killed Harralson.

Blythe's trial was set to begin tomorrow, but the case now goes to the court of criminal appeals.

In a separate case, court documents show Harralson's family is also suing Blythe.
