Shelley Duncan waived her right to have a preliminary hearing on Monday. The former Tishomingo teacher was charged in September 2016 of lewd acts with a child.(KXII)

The former Tishomingo teacher accused of having an inappropriate relationship with a 14 year old appeared Tuesday morning in Johnston County Court.

Shelley Duncan, 49, waived her right to have a preliminary hearing.

Duncan was charged with lewd acts with a child back in April, after police say she was involved with a student in September 2016.

Duncan, her lawyer, Pontotoc County Judge Greg Pollard and the Cleveland County assistant district attorney met behind closed doors when the decision was made.

Duncan's case will now go to trial.

Her formal arraignment is set for Dec. 5.
