Sherman capital murder case heard by U.S. Court of Appeals

SHERMAN, Tex. (KXII) - Attorneys for a Sherman man convicted of killing his wife and children want a new trial.

Andre Thomas is appealing his capital murder conviction in a federal appellate court in New Orleans.

The now 36-year-old confessed to stabbing his estranged wife, their four-year-old son and her 13-months old daughter and then ripping out their hearts back in 2004.

Thomas has since gouged out both of his eyes in prison.

His lawyers say Thomas is too mentally ill to be executed.
